ESPN And Quiksilver Reach Logo Lawsuit Settlement

In what began with ESPN filing suit against Quiksilver over trademark infringement for the use of the letter X, the roles reversed and Quik filed a lawsuit against Walt Disney Co.’s ESPN network that stuck. After six months of legal wrangling, the two companies have reached an undisclosed settlement over ESPN’s use of the letter X in its X Games logo.
According to the LA Times:
“The companies didn’t disclose the details of the settlement in papers filed jointly Monday in federal court in New York. Last month, U.S. District Judge Colleen McMahon denied ESPN’s request to dismiss the case, saying the emblem for its extreme-sports franchise was “strikingly similar” to a stylized “X” found on Quiksilver apparel.
Frank Ryan, ESPN’s lawyer with Nixon Peabody in New York, and Quiksilver’s lawyer, Mark Finkelstein of Latham & Watkins in Costa Mesa, didn’t immediately return calls for comment on the settlement.”
Quiksilver, whose stock has been languishing in recent months, could definitely use some good news.

Whoopdie-doo…it still won’t bail them out of their immense debt. Quik is shutting down 29 underperforming stores in ‘09, most here in So Cal with 9 stores to shutter right off the bat in January. Yikes!!! More pink slips to come.
